1. Acceptance of Terms

By entering and/or making a purchase at Topo, you acknowledge and agree to be bound by these Terms of Service (the "Terms"). If you do not agree to these Terms, please do not enter the Store or make any purchase.

2. Age Restriction

You must be at least 21 years old to enter the Store and purchase products. We reserve the right to request valid identification to verify your age.

3. Product Information & Compliance with Law

  • Hemp and Hemp-Derived Products: All products sold in this Store are derived from industrial hemp and contain less than 0.3% Delta-9 THC on a dry-weight basis, in compliance with the 2018 Farm Act and Tennessee state law (Tenn. Code Ann. § 43-27-101 et seq.).
  • CBD Products: CBD products sold in this Store are derived from industrial hemp and comply with all applicable state and federal laws.
  • No Medical Claims: We do not make any medical claims about the benefits of hemp or CBD products. These products are not intended to diagnose, treat, cure, or prevent any disease. Consult with a healthcare professional if you have any questions about using these products.
  • Labeling: We strive to provide accurate product information, including ingredients and potential effects. It is your responsibility to review product labels and educate yourself on the products you purchase.

4. Prohibited Activities

The following activities are strictly prohibited in the Store:

  • Consumption of any products on the premises.
  • Resale of any products purchased in the Store.
  • Any illegal activity, including but not limited to the possession or use of controlled substances.
  • Disruptive behavior, including but not limited to loud or offensive language, harassment, and physical altercations.

5. Refunds and Exchanges

All sales are final. We do not accept returns or exchanges on any products due to the consumable nature of our merchandise and for sanitary reasons. In the unlikely event that a product is defective, please contact us within [Number] days of purchase with your receipt and a description of the issue. We will gladly replace the defective product or issue a store credit at our discretion.

6. Disclaimer of Liability

We are not responsible for any adverse reactions or other consequences resulting from the use of our products. You assume all risks associated with the purchase and use of our products.

7. Indemnification

You agree to indemnify and hold harmless the Store, its owners, employees, and agents from any and all claims, liabilities, damages, losses, costs, and expenses (including attorney's fees) arising out of or related to your use of the Store or any products purchased from the Store.  

 

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee.

9. Modifications

We reserve the right to modify these Terms at any time without prior notice. Your continued use of the Store following any such modifications constitutes your acceptance of the revised Terms.

10. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck from these Terms and the remaining provisions shall remain in full force and effect.  

 

11. Entire Agreement

These Terms constitute the entire agreement between you and the Store with respect to the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
